These Terms of Service ("Terms") govern your use of the Web Workmen website and services. By accessing our website or using our services, you agree to be bound by these Terms.

1. Services

Web Workmen provides website design, development, hosting, and related services for trade businesses. Our services are described on our website and may include custom website design, website redesign, managed hosting, SEO optimization, and ongoing maintenance.

2. Subscription Plans

Our services are offered on a month-to-month subscription basis. Key terms include:

  • No contracts: All plans are month-to-month with no long-term commitment required.
  • No setup fees: Website design, development, and launch are included in your monthly subscription.
  • Cancellation: You may cancel your subscription at any time. Service will continue until the end of your current billing period.
  • Plan changes: You may upgrade or downgrade your plan at any time.

3. Payment

  • Subscription fees are billed monthly in advance.
  • All fees are in US dollars unless otherwise stated.
  • We reserve the right to change our pricing with 30 days' notice to existing subscribers.
  • Late or failed payments may result in service interruption.

4. Content Ownership

  • Your content: You retain ownership of all text content, images, logos, and branding materials you provide to us.
  • Website design: The website design, code, and structure are part of the subscription service. While active, you have full use of the website.
  • Upon cancellation: You may request your content files (text, images, etc.) to take to another provider. We will make reasonable efforts to provide these within 30 days of cancellation.

5. Hosting and Uptime

Websites are hosted on enterprise-grade Cloudflare CDN infrastructure. While we strive for 99.99% uptime, we cannot guarantee uninterrupted service. We are not liable for downtime caused by factors beyond our reasonable control, including but not limited to network outages, server failures, natural disasters, or cyber attacks.

6. Acceptable Use

You agree not to use our services to:

  • Host, display, or distribute illegal, harmful, or offensive content
  • Infringe on the intellectual property rights of others
  • Transmit malware, viruses, or other harmful code
  • Engage in spam, phishing, or deceptive practices
  • Violate any applicable laws or regulations

7. Limitation of Liability

To the maximum extent permitted by law, Web Workmen shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of our services.

Our total liability for any claims arising from or related to our services shall not exceed the total amount you have paid us in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Web Workmen, its officers, employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

9. Modifications

We reserve the right to modify these Terms at any time. We will notify existing subscribers of material changes via email at least 30 days in advance. Continued use of our services after changes take effect constitutes acceptance of the modified Terms.

10. Termination

We reserve the right to suspend or terminate your account and access to our services if you violate these Terms or engage in conduct that we determine to be harmful to our business, other users, or third parties.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration.
